1. Limited Labor Warranty (Two Years)

Anderson Remodeling (“Contractor”) warrants that all labor performed on the project will be completed in a good and skillful manner, consistent with accepted residential remodeling practices in the State of Texas. 

Contractor provides a Two (2) Year Limited Warranty on workmanship beginning on the date of substantial completion.

If a defect in workmanship is discovered within the warranty period, Contractor will, at its election: 

  1. Repair, 
  2. Replace, or 
  3. Pay the reasonable cost of repair 

for the portion of work found to be defective due solely to Contractor’s workmanship. 

2. Materials Warranty (Manufacturer Only)

All materials, products, appliances, equipment, fixtures, and parts installed by Contractor are covered exclusively by the manufacturer’s warranty, if any. 

Contractor does not provide any additional warranty on materials and is not responsible for manufacturer warranty decisions or coverage. 

Contractor will assist the Owner in obtaining warranty documentation or proof of purchase when reasonably available. 

3. Requirements Under Texas Law (RCLA Notice)

This warranty is governed by the Texas Residential Construction Liability Act (Texas Property Code §27.001 et seq.). 

Before the Owner may file any legal action or seek damages for defective work, the Owner must: 

  1. Provide Contractor with written notice of the alleged defect at least 60 days prior to taking action. 
  2. Allow Contractor a reasonable opportunity to inspect, offer to repair, or make a settlement offer in accordance with the statute. 

Owner’s failure to provide proper notice limits available remedies under Texas law. 

4. Warranty Limitations and Exclusions

This Limited Warranty does not cover: 

  1. Damage caused by owner neglect, abuse, improper use, or lack of maintenance. 
  2. Damage resulting from plumbing leaks, roof leaks, moisture intrusion, or humidity issues not directly caused by Contractor’s workmanship. 
  3. Acts of God, including storms, flooding, fire, winds, or other events beyond Contractor’s control. 
  4. Structural movement, including foundation settling, soil movement, or shifting. 
  5. Normal wear and tear, fading, caulking shrinkage, grout discoloration, or cosmetic issues that do not affect performance. 
  6. Repairs, alterations, or modifications performed by anyone other than Contractor. 
  7. Customer-provided materials or reused materials. 
  8. Damage caused by pest infestation, unless directly caused by Contractor’s workmanship. 
  9. Failures related to HVAC, plumbing, or electrical systems unless Contractor directly performed that scope of work. 

5. Warranty Claim Process

All warranty requests must be submitted in writing to:

  • Description of issue 
  • Date issue was discovered 
  • Photos (if available) 

Contractor will schedule an inspection within a reasonable time and perform warranty work during normal business hours. 

6.Disclaimer of Implied Warranties

To the extent permitted by Texas law, all implied warranties, including the implied warranty of merchantability and fitness for a particular purpose, are disclaimed and replaced by the express terms of this Limited Warranty. 

Nothing in this warranty waives non-waivable statutory rights under Texas law. 

7. Limitation of Liability

Contractor’s total liability under this warranty shall not exceed the original cost of the labor for the portion of work determined to be defective. 

Contractor shall not be liable for: 

  • Incidental damages 
  • Consequential damages 
  • Loss of use 
  • Delay damages 
  • Property damage unrelated to Contractor’s work 

8. Non-Transferability

This Limited Warranty applies only to the original customer and is not transferable unless expressly agreed in writing. 

9. Entire Agreement

This Limited Warranty constitutes the complete and exclusive warranty for the work performed. No oral statements or additional promises modify or expand its terms.
